These Terms of Service (the "Terms") govern your use of the website, applications, and services operated by RedRubric Inc., a corporation incorporated in the Province of Ontario, Canada ("RedRubric," "we," "us," or "our"). The Terms apply to the study, practice, and mock exam tools available at redrubric.com and any related subdomain (together, the "Service"). By creating an account, purchasing an edition, or otherwise using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Service.
You accept these Terms each time you access or use the Service. If you use the Service on behalf of another person, you represent that you have the authority to bind that person to these Terms.
"Account" means the registered profile you create to access the Service. "Content" means the practice questions, answer explanations, mock exam simulations, study guide lessons, and any other material RedRubric makes available through the Service. "Edition" means a purchased tier of access (Starter, Exam Prep, Full Access, or Lifetime), as described on the pricing page at redrubric.com/pricing. "TEAS" means the Test of Essential Academic Skills, an examination administered by Assessment Technologies Institute, LLC ("ATI"). "HESI A2" means the HESI Admission Assessment, an examination administered by Elsevier Inc. ("Elsevier"). "Exam" means the TEAS or the HESI A2, as applicable to your use of the Service. "You" and "your" mean the individual who creates an Account or otherwise uses the Service.
You must be at least 13 years old to create an Account or use the Service. By using the Service, you represent that you meet this minimum age requirement. If RedRubric learns that an Account belongs to a person under 13 years old, RedRubric will close the Account.
RedRubric is an independent study manual and original question bank for nursing entrance exams: the ATI TEAS 7 and the HESI A2. The Service includes subject-area practice questions, full-length timed mock exams, structured study guides, and a daily practice feature. Every Edition covers both exams.
RedRubric is not affiliated with, sponsored by, or endorsed by ATI or Elsevier. RedRubric's questions are written independently and are not reproduced from any current or past live TEAS or HESI A2 examination. Section 17 explains this relationship in more detail.
To use most features of the Service, you must create an Account using an email address and password, or by signing in with a Google account. You are responsible for maintaining the confidentiality of your Account credentials and for all activity that occurs under your Account. Notify support@redrubric.com immediately if you suspect unauthorized use of your Account.
You may create and maintain one Account for your own personal use. Section 8 describes the restriction on sharing Account access with other people.
RedRubric offers several Editions of paid access: Starter, Exam Prep, Full Access, and Lifetime. Current pricing, currency, and the features included in each Edition are listed at redrubric.com/pricing and may change from time to time; a change in pricing does not affect an Edition you already purchased.
Every Edition is a single, one-time purchase. No Edition automatically renews or recurs. You are charged once, at the time of purchase, and you are not charged again unless you make another purchase. Payment is processed by Stripe, Inc.; RedRubric does not receive or store your full card number. Prices may include or exclude applicable taxes depending on your location; where tax applies, it is added at checkout.
Purchases are governed by RedRubric's Refund Policy at redrubric.com/refund-policy, which forms part of these Terms.
When using the Service, you agree that you will not:
RedRubric may suspend or terminate an Account that violates this Section 8, as described in Section 11.
RedRubric owns all right, title, and interest in the Content, including the practice questions, answer explanations, mock exam structure, and study guide lessons. Subject to your compliance with these Terms, RedRubric grants you a limited, personal, non-transferable, non-exclusive license to access and use the Content for your own Exam preparation. This license ends if your Account is closed or your access to the relevant Edition expires.
The Service relies on third-party providers to operate, including payment processing (Stripe), sign-in (Google), and others described in full in the Privacy Policy at redrubric.com/privacy. Your use of these providers' features is also subject to their own terms.
RedRubric may suspend or close your Account, with or without notice, if you violate these Terms, including the Acceptable Use rules in Section 8. You may stop using the Service, and close your Account, at any time by contacting support@redrubric.com.
Closing your Account, whether by you or by RedRubric for a violation of these Terms, does not entitle you to a refund for any purchase already made, except as described in the Refund Policy.
The Service is provided "as is" and "as available," without warranty of any kind, whether express or implied. RedRubric does not guarantee that using the Service will result in a particular Exam score, admission to any nursing program, or any other outcome. Practice questions and mock exams are study tools; your actual result on the live examination depends on many factors outside RedRubric's control.
To the fullest extent permitted by law, RedRubric will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service. RedRubric's total liability for any claim arising from these Terms or the Service will not exceed the amount you paid to RedRubric in the twelve months before the claim arose.
You agree to indemnify and hold RedRubric harmless from any claim, loss, or expense, including reasonable legal fees, arising from your violation of these Terms or your misuse of the Service.
RedRubric may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. If a change is material, RedRubric will make reasonable efforts to notify you, such as by email or an in-product notice. Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict of laws principles. You agree that any dispute arising from these Terms or the Service will be brought exclusively in the courts located in Ontario, Canada, and you consent to the jurisdiction of those courts.
TEAS® and ATI® are trademarks of Assessment Technologies Institute, LLC. HESI® is a registered trademark of Elsevier Inc. RedRubric uses these terms only to describe the examinations for which the Service prepares you. RedRubric is not affiliated with, authorized by, or endorsed by ATI or Elsevier, and no such affiliation should be inferred.
